Questions? We Have Answers.
Question #1: WHAT IS A “CERTIFIED LEGAL DOCUMENT PREPARER (CLDP)?”
Answer: A CLDP is an individual or business entity who is a non-attorney certified through the Arizona Supreme Court to assist others in Arizona, providing document preparation assistance and services to individuals and entities not represented by an attorney.
Question #2: WHAT CAN A CLDP DO?
Answer: Legal document preparers:
· prepare documents (without the supervision of an attorney) for the general public or a business entity;
· may provide general legal information as to the procedural requirements of a party in a particular area of law;
· use tools to perform their own basic legal research at a Law Library or on the internet; and
· seek assistance and/or guidance from an attorney.
A legal document preparer must be aware of and avoid even the appearance of impropriety at all times. AZ Legal Documents by JoJo places a high value on keeping the highest standards of professionalism and honorable conduct, to secure your confidence in utilizing our services.
Question #:3 HOW MUCH DOES IT COST TO HIRE A CLDP?
Answer: The rates vary depending on the company. Our rates are almost always substantially more affordable than hiring an attorney, and are generally a flat fee, so they do not depend on the amount of time spent on the case.
Question #4: WHAT IS THE DIFFERENCE BETWEEN A LEGAL DOCUMENT PREPARER AND A PARALEGAL?
Answer: A paralegal must be under the supervision of a licensed attorney for whom an active member of the Arizona State Bar is responsible. A certified legal document preparer does not require supervision by a licensed attorney. However, a CLDP must comply with the laws, court rules, and orders adopted by the Supreme Court governing legal document preparers in this state. A CLDP must also successfully pass the CLDP Exam at the Arizona Supreme Court that consists of a test on legal terminology, client communication, data gathering, document preparation, ethical issues, and professional and administrative responsibilities pertaining to legal document preparation, as identified through a job analysis conducted by the board.
In order to maintain certification, a CLDP must attend a minimum of 10 hours of approved continuing education each year, and renew the CLDP’s certification, or license, every 2 years.
Question #5: WHAT IF I HAVE A QUESTION THAT THE CLDP DOES NOT KNOW THE ANSWER?
Answer: When a CLDP cannot answer a question without it constituting legal advice, there are times when a customer will have to seek answers to some of his or her questions from a licensed attorney. When our CLDP is asked a question that falls under the category of legal advice, she will notify customers that they need to schedule a consultation with an attorney.
